The Safety of Life at Sea (SOLAS) Convention - the foundational maritime safety treaty - classifies any vessel carrying more than 12 paying passengers as a 'passenger ship' subject to dramatically stricter regulation: structural fire protection equivalent to cruise ships, lifeboat capacity for every soul aboard with required davit launching, additional crew certifications, and commercial-passenger insurance regimes.
Yacht charters worldwide stop at 12 passengers because crossing that line transforms the yacht into a different regulatory category.
A 70-metre superyacht with cabins for 18 guests will charter with a maximum of 12 guests aboard - the additional cabins are either kept empty, used for crew overflow, or available only on private (non-charter) use by the owner. Operational consequences for chartering: if you have 14 guests in your party, you have two options. (1) Charter two yachts simultaneously for a 'flotilla' itinerary - common for weddings and milestone events. (2) Add 'day guests' for selected occasions: people who join the yacht for a daytime event (lunch, sundowner) but disembark by midnight.
The 12-pax rule applies to overnight passengers, not to day visitors. Why the rule matters for itinerary design: a 12-guest superyacht charter must have everyone aboard from embarkation through disembarkation.
Adding or swapping guests mid-charter (a relative joining for two nights) requires they count against the 12 cap whenever aboard.
This is a real operational constraint that needs design in advance.
Why it matters for UHNW charterers
The 12-passenger rule is the single hardest constraint in luxury chartering - it cannot be negotiated, paid around, or worked around. Buyers planning charters for groups of 13+ should hear about the rule in their first conversation with a broker. Discovering it after signing a contract is a brand-damaging surprise.

12 overnight guests aboard a 40m motor yacht. For the birthday dinner at anchor in Schinoussa, 8 additional day guests arrive by tender from a shore-side villa, dine aboard, return to the villa for the night. Fully compliant with the 12-pax rule.

Can I get an exemption from the 12-passenger rule?
No. The rule is a flag-state and IMO regulation, not a yacht-operator policy. It applies universally to commercial yacht charter worldwide.
Does the 12-passenger rule include children?
Yes. Every soul aboard counts as a passenger regardless of age. A family of 4 adults + 4 children + 4 grandparents = 12, at capacity.
Does the rule apply to private (non-charter) use?
No - private use of an owner's yacht is not subject to the 12-pax limit. The owner can host as many guests as the yacht's safety equipment supports. The 12-pax rule only applies when the yacht is being commercially chartered.
How does the rule work on a day charter?
The 12-passenger rule applies equally to day charters. Yachts offering day-charter formats may also be limited by local port regulations to fewer than 12 in some jurisdictions.
Can I charter a yacht for 14 if I 'rotate' guests through?
No. The rule is about peak number aboard at any moment, not total exposure across the week. Two guests stepping ashore so two others can board still means 12 cap held at any time. Pre-plan this carefully.
