Who is legally bound to silence on a 50 metre charter, and who is not?

The bound list is short and precise. Clause 6(c) of the MYBA Charter Agreement states that "the Captain and Crew are bound at all times to keep all information related to this Charter, the OWNER, the CHARTERER, and all Guests as confidential and no information is to be disclosed to any third party without prior permission of the CHARTERER in writing." On a 50 metre yacht that is typically ten to fourteen people, and the clause covers all of them equally, from the captain to the deckhand who takes the tender in. The unbound list is longer: shore agents, provisioners, the marina, drivers, the fixed-base operator at the airport, and every private security contractor you did not hire through the contract. On a charter at this level the discretion work is mostly about how few of those people need to know anything at all, and it is done before you arrive rather than managed once you are aboard.

Can our movements be kept off public tracking sites?

Partly, and it is worth understanding which part. AIS carriage is governed by SOLAS Chapter V, Regulation 19, which requires it on ships of 300 gross tonnage and upwards on international voyages and on all passenger ships whatever their size. Above roughly 40 metres you are usually inside that requirement, and once a yacht is fitted the system must stay in operation: the master may switch it off only if continual operation might compromise the safety or security of the vessel, and the silence has to be logged with its reason. Privacy is not one of the permitted reasons, so treat any offer to go dark as a warning about the broker rather than a feature. What is true and useful: the AIS signal carries the vessel, not the guest list. The yacht is identified by its own name and its owning company, and nothing in the transmission connects it to you. Where the exposure actually comes from is the quay, the flight, the restaurant booking and the social account of another guest, which is where the planning belongs.

What should we ask a broker to prove before signing at this level?

Four things, all documentary, all answerable in a day. Show us Clause 6(c) in the contract you are proposing, so we can read the confidentiality wording ourselves rather than take a summary. Confirm what the crew have signed: an NDA is normally issued by the owner or the management company and is written into or annexed to the Seafarer Employment Agreement, which the Maritime Labour Convention 2006 governs, and under which the seafarer has the right to take advice before signing. Show the yacht's Greek charter licence, because a yacht without one cannot legally take you and no privacy arrangement survives a port inspection. And name the membership you claim, in a directory we can open.
