One clause, and it is worth reading rather than trusting. The MYBA Charter Agreement, which is the form we write on, says at Clause 6(c): "The Captain and Crew are bound at all times to keep all information related to this Charter, the OWNER, the CHARTERER, and all Guests as confidential and no information is to be disclosed to any third party without prior permission of the CHARTERER in writing." Three things follow from the wording. It binds the Captain and the whole crew, not just the senior officers. It covers the charter, the owner, you and every guest aboard, not only you. And the permission that lifts it is yours, in writing, which means no one aboard can decide on your behalf that a photograph is harmless. Ask any broker to show you that clause in the contract they are proposing before you sign it.

Not for privacy, and any broker who offers it is telling you something untrue. AIS carriage is set by SOLAS Chapter V, Regulation 19: it applies to ships of 300 gross tonnage and upwards on international voyages, and to all passenger ships irrespective of size. A yacht that is fitted with AIS must keep it in operation, and the master may switch it off only where continual operation might compromise the safety or security of the vessel, with the time and the reason recorded in the log and the system returned to operation once the concern has passed. What genuinely reduces your exposure to public tracking sites is different and legal: many crewed charter yachts in Greece sit under 300 gross tonnage and are therefore outside the carriage requirement to begin with, and the yacht is listed under its own name and ownership structure rather than yours. Your name is not in the AIS signal. Your movements can be.

Often, and the useful thing to understand is that it is extra rather than essential. The charter contract already binds them: Clause 6(c) is the confidentiality obligation itself, and it applies whether or not anyone signs anything further. A separate NDA is an owner or management-company practice layered on top of that, normally written into or annexed to the Seafarer Employment Agreement. The SEA is governed by the Maritime Labour Convention 2006, which the MYBA agreement names directly at Clause 6(b), and under which a seafarer has the right to review terms and take advice before signing. That last point matters more than it sounds: an NDA a crew member was rushed into is the one most likely to be argued over later. So the question worth asking a broker is not whether the crew have signed something. It is which document binds them, and whether you can read it.
